I was told by Sen. Gordon Smith's office this morning that Senate
Majority Leader Harry Reid wants a vote on the federal hate crimes
bill before Congress adjourns for the summer. That means by the end
of this week!

Smith's spokesman said the hate bill was introduced several weeks ago
as an amendment to the military reappropriations bill only to speed
up the process. It could be as easily submitted as a stand alone bill
anytime Reid can fit it into the Senate's busy schedule.

Clearly, we do not necessarily have until September to protest the
hate bill. We must immediately overwhelm the Senate with calls. Call

Asheville NC – A couple who said they were protesting the state of the country by flying the U.S. flag upside down with signs pinned to it found themselves in jail following a scuffle with a deputy Wednesday morning.

Mark and Deborah Kuhn were arrested on two counts of assault on a government employee, resisting arrest and a rarely used charge, desecrating an American flag, all misdemeanors. The Kuhns were released from custody Wednesday afternoon.

"This is surreal," Deborah Kuhn, 52, said moments after her son Mark Stidham paid $1,500 bond to get the couple out of jail.

Arrest reports show Buncombe County Sheriff's deputy Brian Scarborough went to the Kuhns' home on 68 Brevard Road about 8:45 a.m. Wednesday to investigate a complaint of an American flag on display after being desecrated.

State law prohibits anyone from knowingly mutilating, defiling, defacing or trampling the U.S. or North Carolina flags. Lt. Randy Sorrells of the Buncombe County Sheriff's Office said the Kuhns desecrated the flag by pinning signs to it, not by flying it upside down.

An upside-down flag typically is flown as a distress signal. The Kuhns said they flew it this way not out of disrespect but to symbolize the state of the country.

Deborah Kuhn said the signs pinned to the flag included an explanation on the meaning of an upside-down flag and asked to "help our country." One of the signs was a photo of President Bush with "Out Now" written on it, they said.

The couple flew the flag for about a week before Wednesday.

Police visits

Deborah Kuhn said an Asheville police officer stopped by last week to make sure the couple was OK, after recognizing the upside-down flag as a distress signal.

Asheville police calls for service records show an officer did go to the house July 18 after a complaint about the upside-down flag. The officer did not issue a citation or file a report.

A couple of days later, Deborah Kuhn said a man dressed in fatigues came to the door to "harass my husband" about the flag. Someone also took photos of the flag, she said.

Sorrells said a resident approached Scarborough while he was on duty and alerted him to the flag. Sorrells said he did not know where the person approached Scarborough or what the deputy was doing.

According to the Sheriff's Office, Scarborough went to the Kuhns' home and gave Mark Kuhn a copy of the flag desecration statute. Scarborough told the Kuhns the flag was being displayed illegally.

Although the Kuhns live within the Asheville city limits, Sorrells said the complaint was made to a deputy.

"We have jurisdiction throughout the whole county of Buncombe," Sorrells said. "We have a citizen that complains to us about a violation of law, we're bound by oath to act on it."

Scarborough told Mark Kuhn he was going to be issued a citation and asked for identification. Kuhn refused, slammed the door on the deputy's hand, breaking the glass pane out of the door and cutting Scarborough's hand, the Sheriff's Office said.

Deborah Kuhn said they removed the flag from their front porch after Scarborough threatened to cite them, but they objected to showing Scarborough their IDs, which he needed to write the tickets. Scarborough then broke into their house and came after them, they said.

"He tried to keep us from closing the door, but we managed to get it closed," Deborah Kuhn said. "We locked the door and he broke the glass to our front door and proceeded to assault my husband, saying, 'You're under arrest.'"

The Sheriff's Office said a struggle ensued when Scarborough followed Kuhn back into the house. At that time, Deborah Kuhn also struck Scarborough in the face, authorities said in arrest reports.

Scarborough called for backup and five squad cars responded, Sorrells said.

Deborah Kuhn said she called 911 and ran into the street screaming for help.

Mark Kuhn said he did not attack Scarborough.

"He came after me, and I fought him back," Kuhn, 43, said. "After I got out of his hold, I ran outside."

Rarely enforced

Sorrells said this is the first time he has seen the flag-desecration law enforced. He said it's a difficult decision for an officer to weigh a resident's right to free speech against another's complaint of a law violation.

"I think the officer did the appropriate thing by stating his intention to simply issue a citation and let it be worked out in court," Sorrells said. "If Mr. Kuhn had simply complied with that request for identification and accepted the citation, we would have all gone about our way, and it could have been worked out in court. Once he assaulted the officer, it escalated very quickly."

Sorrells said Scarborough suffered some scrapes and cuts to his hand and returned to duty later Wednesday. A message left for Scarborough at the Sheriff's Office was not immediately returned.

Mark Kuhn, who said he had flown his flag upside down before without any problems, said he plans to fight the charges. The Kuhns each face a maximum 420 days in jail if convicted on all of the charges.

"We are going to do our best to get a civil liberties lawyer from the ACLU," Kuhn said.

"We are going to take this big time. Officer Scarborough is not going to get away with this."

The Kuhns said the Sheriff's Office kept their flag. Sorrells said he had no record of that.

Tucson, AZ - Apparently most news-media people - and possibly most
other Americans (especially those who never watched or listened to
the original murder trial) - are totally convinced O.J. Simpson WAS
guilty of murdering his wife and wrongly "escaped" justice. Angrily,
they now demand "retribution" and want Simpson punished (perhaps with
Life in prison) for the overblown fiasco in Las Vegas. For the
reasons listed below, I suggest the "hang O.J." majority may be
mistaken. In June of 2,000 I Emailed the following to several hundred
establishment and alternative media people, with information about
the OJ Simpson trial that most of them seemed ignorant about. (Only a
few even acknowledged the Email.) Please read it and judge for
yourself...

* Chicago private investigator Sherman Skolnick publicly contended
that members of the narcotics-distributing Japanese Mafia, the
YAKUZA - or - competing Mexican Herrera mob, slaughtered drug-dealing
Nicole and Ron... Skolnick further claimed the murder was filmed by
the DEA - and also watched by O.J.'s own detectives. None attempted
to stop the murders. According to Skolnick, to cover up the role of
the narcotics gangs, the crooked L.A. police framed Simpson...

Further below in this Email, read Skolnick's essay about the above as
presented years back on Chicago Public Access TV. I think you will
also be amazed to read Skolnick's allegation that some giant American
banks are (or were then) mostly owned by the Japanese Yakuza mafia;
Bank of America and Wells Fargo.

famous, paraplegic Chicago private investigator whose earlier
revelations about a bunch of corrupt Illinois Judges - including

show in Chicago.)

* At the O.J. murder trial, defense lawyer Lee Bailey's questioning
of the two original investigating detectives (not Furman) demolished
the prosecution's case against O.J. in the very first days of trial
testimony! The detectives' testimony was never again mentioned by the
media (or even by showy, but inept defense lawyer Johnny Cochran)...
but it was REMEMBERED by the Jurors in the first trial.


On a single later network TV interview, several of the jurors said
the early testimony (following) convinced the entire jury to vote
O.J. innocent. Their TV interview comments were also ignored and not
further repeated by the rest of the media.


(My wife and I watched on TV or listened on radio to the ENTIRE O.J.
murder trial from the first day.)

But FIRST, recall the Prosecution's scenario... The waiting, but
impatient (nearsighted) chauffeur, testified he saw a dark figure
(obviously the panicked, blood spattered O.J. rushing from the
murders) going in the front door of his house. In his upstairs
bedroom O.J. washed off the evidence, stuffed his bloody clothes in a
bag and rushed down to be driven off to the airport. A
little "problem" there... The prosecution skipped over the fact that
in what amounted to only a relatively few minutes, O.J came out of
his house showered, spic and span, carrying some of his bags. And
other of his bags were ALREADY sitting outside the house.

In early questioning of the 2 main detectives, F. Lee Bailey got them
to admit some incredible things!

Following is THE testimony the jurors remembered that led them to
find O.J. innocent....

* Detective Lange admitted to F. Lee Bailey, they could not find a
trace of blood OR dirt on the white (or light covered), stairs or on
the walls leading to O.J.'s upstairs bedroom.... OR on the white
bedroom carpet OR in the bathroom. (The single dark sock with his
blood spot went strangely "unnoticed" until days later.)

* The same detective then testified that they took apart ALL the
plumbing in the bathroom but could not find one drop or flake of
blood in the pipes! The media people present heard this but never
later repeated that testimony!

Influential Radio Talk show hosts Rush Limbaugh and G. Gordon Liddy
DIDN'T hear it. They had decided Simpson was guilty BEFORE the trial
began (and pronounced him guilty to their trusting listeners). But my
wife and I heard it. And the Jurors heard it. And the Jurors
remembered!

Is O.J. one of the world's greatest magicians?...

In faxes to (pompous) Rush and Liddy during the O.J. trial, I
repeated the detectives' testimony. And I also suggested to them that
O.J. must be one the world's greatest magician-murderers.... O.J.
LEVITATED up the stairs into his bedroom... disintegrated his bloody
clothes... bathed and dried in Ethereal water that disappeared.


Caused clean clothes to form around his body... all in just a few
minutes of entering the house. Then (still levitated) he floated down
the stairs to his front door. BUT the big dummy made ONE MISTAKE! He
dropped one sock stained with a drop of his blood, on the bedroom
floor!

And about Shapiro and the bloody Glove(s) that "didn't fit."
Something Shapiro told to G. Gordon Liddy later is worth
mentioning...

* Long after the first trial. SHAPIRO (no friend of O.J. Remember he
suggested O.J. confess in a plea bargain) told Liddy during a radio
interview that I heard, that he (Shapiro) had tried on the murder
glove(s) the night before... He found them snug. Shapiro told Liddy
that he went to see O.J. the next day and asked O.J. to put his hand
up against Shapiro's hand.

When Shapiro saw how HUGE O.J.'s hand was against his own... Shapiro
told O.J.: "TRY ON THE GLOVES!" (He did in court. Didn't fit.)

Certainly Liddy and Shapiro should remember that program. I certainly
do! (Shapiro has also since died.)

Details of the O.J. Simpson Affair

Harsh realities need to be understood. Yet, the mainstream press
seldom tells us. Just as if someone out there is saying, "Shut your
mouth!"

A case in point is the O.J. Simpson Affair.

HARSH REALITY #1 -- SHUT YOUR MOUTH: To be a major sports star, do
you have to get along well with criminal interests?

Does that make you a mafia crony, or just promoting your career in
the face of the real world? Skeptics need to examine the federal case
of Norby Walters and Lloyd Bloom. The court trial, 1988-89, showed
that known gangsters seemed to control sports agents who, in turn,
controlled sports stars. (One of the mafia-dominated sports agents
was later murdered.) Cynics point to the fact that a higher court
judge, reportedly pals himself with mafioso, overturned the
convictions of the sports agents charged with corruption and threats.

The major news organs are heavily into sports promoting. Some, like
the Chicago Tribune, own a baseball team (The Cubs). The TV networks
reportedly find it necessary to be cronies of criminal interests in
promoting sports events. It is called avoiding financial hang-ups.

So if we conclude that O.J. Simpson, from early in his career, found
it necessary to be a gangster pal, should we be sympathetic? Probably
so. As a former sports hero, O.J. was sponsored by Hertz, the car
rental firm. Going back into their history, one finds that they
reportedly were no angels. Some savvy folks whisper that Hertz, in
the past if not also the present, were reportedly close to criminals.

And O.J. reportedly was a sizeable owner in a nationwide storage firm
reportedly started by an intelligence agent who was also close to
foreign and domestic gangsters. (The founder was sent to prison for
massive S&L fraud in California.)

The list of O.J.'s reported criminal links goes on and on.

O.J. reportedly owned several fast food stores. Sounds innocent
enough. As part of the bitter divorce, ex-wife Nicole Brown Simpson
got control of some of those businesses. And into the picture were
brought corrupt police brass as secret owners/operators. The places
were reportedly turned into dope distribution centers, with the huge
cash flow disguised as proceeds from business.

Remember: food stores, restaurants, and other large receivers of
cash, are exempt from U.S. Treasury regulations requiring a report on
where more than ten thousand dollars comes from, if deposited with a
financial entity like a bank.

And the funds from the stores, as well as from some of the Hertz
franchises she controlled, were washed through California banks --
most of which are owned by the Japanese, and a principal portion
being the Japanese mafia, the Yakuza.

HARSH REALITY #2 -- SHUT YOUR MOUTH: Two major dope gangs distribute
dope in California, and wash the loot through businesses and banks.

Gang #1 are the Herrera dope gang of Mexico, tight with the American
CIA. For political survival, state and federal prosecutors and law
enforcement officials know it is forbidden to start up with the
Herreras. Safer to grab some street corner doper-nobody. To promote
so-called "national security," the mainstream press knows it is
generally forbidden to publicize spy agency confederates and CIA's
dirty tricks.

Dope gang #2 are the Yakuza who, like the Herreras, are tight as well
with the CIA. (See the book, "Yakuza" by David E. Kaplan and Alec
Dubro.)

Prior to the double murders, O.J. reportedly told business associates
that his ex-wife Nicole and her friend Ron Goldman, and their
confederates, were dealing dope. O.J. reportedly said he told Nicole
and Ron to stop it, or he would stop it, because the dope dealing was
endangering his family and his other businesses. (Was that a threat
by O.J.? Stop it? How?)

To keep track of this dope dealing, and because of his jealousy of
his ex-wife Nicole, O.J. had detectives tracking Nicole (also
tracking Ron?).

THE REPORTED SCENE ON THE NIGHT OF THE DOUBLE MURDERS: SHUT YOUR
MOUTH! --

An undercover federal drug enforcement team, equipped with see-in-the-
dark video, were tracking Ron. From past surveillance, they firmly
believed he was part of a widespread homosexual dope gang, fronting
for the Yakuza -- distributing the stuff *on* *credit* to fancy
people, celebrities and such, contacted through waiters (like Ron) in
fancy eating places like the Mezzaluna Restaurant where Ron worked.
Ron's reputed sidekick and fellow waiter was MICHAEL NIGG. (Was Nigg
also Ron's room-mate, or did Nigg have a girl friend as a "beard?")

THE PHONE CALL: SHUT YOUR MOUTH! --

On the night of the double horror, Nicole reportedly received a phone
call from a friend, pleading that ex-husband O.J. has to come up,
pronto, with several hundred thousand dollars -- or else -- to make
good a dope debt.

THE BUTCHER JOB: SHUT YOUR MOUTH! --


Both the narcs and O.J.'s detectives reportedly witnessed Nicole and
Ron cut up, Samurai-style, by a dope hit team. The video reportedly
shows them as 3 or 4 hispanics or orientals. If the trial evidence is
true, was that O.J.'s shoe-print at the murder scene, *after-the-
fact*, alerted by his detectives reportedly having witnessed the
bloodbath?

Naive people ask: Why didn't the narcs and/or the detectives stop the
murders? For one thing, the narcs know their top dogs at the U.S.
Drug Enforcement Administration are highly corrupt, and have given
the Herreras and other major dope traffickers a pass. (See the
book, "The Underground Empire," by James Mills.)

Also, both teams knew better than to interfere with the bloody turf
wars between the Herreras and the Yakuza in California.

Insofar as the L.A. police later planted "evidence" implicating O.J.,
was this a type of police "logic"? "Well, O.J. is in with criminals
anyway, so let's sink him one way or another."

THE ROLE OF THE JUDGE AND HIS WIFE: SHUT YOUR MOUTH! --

O.J. trial judge Lance Ito was reportedly in a position to know what
the double murders were really all about. His wife, L.A. Police
Captain Margaret York, has been in charge of investigating police
department corruption. Captain York reportedly knew of the other
police brass as the corrupt secret owners/operators of the fast food
sites, formerly O.J.'s businesses (Did O.J. still retain an
interest?).

Captain York reportedly also was the liaison to DEA and examined the
files and records of the undercover narc team as well as the video.

The District Attorney was also in a position to know. O.J. defense
team member, lawyer Robert Shapiro, is reportedly close with known
major drug traffickers. Are they just "clients"? Did defense attorney
Johnnie Cochran know? Judge Ito blocked Cochran from trying to bring

Others who apparently found out inside details and the terrible
secrets of the O.J. Simpson Affair apparently had to be snuffed out.

VICTIM #1: Judge Ito's courtroom bailiff in the O.J. case, Antranik
Geuvjehizian, murdered in July, 1995. A TV network program in a
notice in various TV guides, called it by the name of the
series, "Unsolved Mysteries." But, it did not go on the air as
scheduled for Friday, October 27, 1995. So the program has its own
unsolved mystery.

VICTIM #2: Robin Clark, covering the trial for the Philadelphia
Inquirer, a somewhat more independent and outspoken paper -- he
apparently was murdered by having his car shoved into on-coming
traffic.

VICTIM #3: His son disappeared during the trial. Was he kidnapped?
The police did not accept the story when CBS reporter at the trial
Dominic Dunne's son returned.

VICTIM #4: In September, 1995, about 3 weeks before the verdict by
the jury, Ron Goldman's fellow waiter and reputed dope gang member,
Michael Nigg, was murdered by assassins who shot him in the head.

Did any of these victims have inside data about the Mark Fuhrman
details -- a bigoted L.A. detective who apparently planted "evidence"
incriminating O.J.? The Fuhrman details -- him hating blacks and
such -- was that intentionally put into the case by *both* *sides*?
Defendants have been known to pay for prosecutors to corruptly
sabotage the prosecution of a defendant, to save a defendant from
jail. In law, errors in the trial that could on appeal of a guilty
verdict invalidate that verdict, are called "reversible errors."
Sometimes they are just accidental. Sometimes, they are corruptly
arranged. Were the Mark Fuhrman bigot-revealing tapes arranged ahead
of the time -- known ahead of time -- so that revealing that would
throw out later a guilty verdict against O.J.?

In the criminal defense of O.J., supervising those detectives
(different bunch than those reportedly at the murder scene) was a

Why was that ex-cop brought in to head the detectives of the defense
team? Reportedly because he is an expert on gay violence and on
*dope* *hit* *teams*. So that was apparently early-on known or
suspected of what the double murders were all about.

And this reputed mafia-friendly ex-cop reportedly dug very, very deep
into the dope business. And he came up apparently with a link to the
California turf dope wars between the Herreras and the Yakuza, linked
to the CIA-dope and guns operation throughout the southern states,
starting in the 1980s. Among the links was to the CIA-dope brought in
through the strange airport at Mena, Arkansas, arranged by Ollie
North and George Bush. Clinton claims now that as governor he was
told by the CIA to mind his own business, that it was one of their
covert operations and he was not to interfere.

So, if the public now demands that the secret DEA records and video
of the double murders be released -- well, the highly corrupt DEA
bosses are inclined to withstand the pressure. And so also opposing
public disclosure would be the Clinton White House. The DEA and
Clinton are subject to blackmail, as a result of the digging
reportedly by the ex-cop from New York.

Some at DEA reportedly claim that they would like to ask Ron's
father, Fred Goldman, if he knew about his son's dope dealing. But
Fred Goldman has mobilized public opinion to his favor and may be
immune from hard questions like that.

This all may be the biggest or one of the biggest scandals of the
20th century -- the apparatus of state and federal government
covering up a double murder.

NOTE: Soldiers, by nature, typically don't complain. In other words,

A citizen's arrest warrant has been issued! Please do your duty and
see that it is served!

As George Bush made his appearance and speech today at the United
Nations in NYC, 1,000 people issued a citizen's arrest warrant
against him for war crimes and crimes against humanity.

The day began with twelve separate feeder marches converging from
across the city, consisting of perhaps several hundred protesters.
The people carried 20 large coffins with them and marched from all
five boroughs toward Dag Hammarskjöld Plaza and the UN Building where
Bush was speaking. The feeder marches were organized by Arrest Cheney
First, the War Resister's League, Witness Against Torture, Movement
for a Democratic Society (MDS-NYC) and others.

Police had already set up a protest pen outside of the UN for a rally
called by the vanguardist World Can't Wait, and quickly moved to herd
the marchers into the pens. When members of the War Resister's League
exited the pen to deliver the arrest warrant, police arrested 8 of
them and grabbed three or four unaffiliated protesters from the pen
as well, at approximately 10:30 am.

Eventually, the original contingent of marchers and several hundred
others got tired of the pens and began to march south on Second
Avenue toward Washington Square Park. A few attempts were made to
march in the street, but police reacted violently, shoving and
pushing marchers back onto the sidewalk. In the process, police also
seized any megaphones they saw. Several protesters sustained injuries
in these encounters, but no arrests were made. In all, about 500
people made their way to Washington Square Park.

The idea of citizen's arrest has its roots in common law, and allows
for any citizen to execute an arrest on someone who they witness
committing a felony offense. All states in the United States allow
for citizen's arrest, except for North Carolina, which follows
different statutes. Those undertaking a citizen's arrest can still be
held liable in civil or criminal court for any damages they inflict
in the process. However, they have full rights to detain and arrest a
suspect who they witness in commission of a felony.

Applicable felonies in this case include, but are not limited to:
treason, conspiracy to pervert the course of justice, conspiracy to
obstruct justice, perjury, conspiracy malfeasance in office, fraud,
embezzlement, and kidnapping.

Under established international and military law, also, the
commission of war crimes and crimes against humanity, for which, as
commander in chief, Bush bears command responsibility for the actions
of those under his command as well as for his own policies.

Under the principles of the Nuremburg Trials at the end of World War
Two, Bush would be indictable for all four counts established back
then:

1. Participation in a common plan or conspiracy for the
accomplishment of crime against peace;

2. Planning, initiating and waging wars of aggression and other
crimes against peace;

3. War crimes;

4. Crimes against humanity.

While the efforts of citizens today to serve an arrest warrant on
Bush failed, be advised: the warrant stands. Please do you duty, and
try at every opportunity to bring this criminal to justice.

Fight Over Driver Licenses for Illegal Immigrants.

Rachel Barnhart (Rochester, N.Y.) -- On Tuesday, Monroe County Clerk Cheryl Dinolfo (R) said she is ready to stage a showdown with Governor Eliot Spitzer (D) over a plan to allow illegal immigrants to obtain New York state driver licenses.

"I find the state's plan wrong and offensive," she said.

Starting in the end of the year, the new state policy will allow immigrants to use a passport or birth certificate--not proof of legal residency--to get a license.

Spitzer said giving illegal immigrants the right to drive legally will make the roads safer. He said unlicensed drivers account for five times the number of deadly accidents as licensed drivers.

He also said the policy will have anti-fraud measures that will increase the security of licenses.

Some Republican State Assembly members joined Dinolfo in denouncing the plan and promising action against it. They fear the new policy will attract more illegal immigrants to the state and devalue the license as a form of identification. They also said it would leave New York more vulnerable to terrorist attacks.

The Monroe County Legislature plans to pass a law forbidding the county clerk from enforcing the rule.

At the same press conference, Democratic volunteers handed out remarks from the governor which said the politics of fear and selfishness have replaced the politics of common sense and mutual responsibility.

Immigrants and their advocates differ on their opinion of the new policy.

Vandana Soni came to the United States from India one week ago. As a legal immigrant, she can apply for a driver's license. She thinks it's wrong to allow those here illegally to have the same privilege.

"I don't think they should have licenses, because they don't have Social Security numbers. We cannot rely on that person. Also, we don't know the background of that person also," she said.

Restaurant owner Mario Daniele, a naturalized citizen who was born in Italy, agrees.

"The least I believe we ought to do is not automatically issue a driver license or any form of identity that permits these people to go through the nation and our state irregardless of their conduct," he said.

However, another naturalized citizen, Josefno Paz, agrees with the new policy.

"People are driving anyways, so if they get a chance to learn how to drive properly, it will help us, help many people in the community," she said.

Donna Spence, who works at the Brockport Migrant Education Program, believes it's a good move.

"It makes sense to me, that if they are here and we're benefiting from their work we need to give them a legal way to drive to work," she said.

Spitzer said up to one million undocumented immigrants live in the state. His office considers the new policy state law, and may take legal action against any clerk's office that doesn't follow it.

There is also a possibility that people who are denied licenses could sue the clerk's office.

State Assembly Minority Leader James Tedisco on Friday threatened to file a lawsuit if Gov. Eliot Spitzer does not reverse course on an executive order allowing illegal immigrants to obtain driver's licenses in New York state.

Before going that route, he first will attempt to reverse the policy change through legislation when the Assembly resumes session on Oct. 22, Tedisco, R-Schenectady, said in a telephone interview.

"November first, if it doesn't, we're filing a lawsuit on behalf of the people of New York," he said.

Also on Friday, Saratoga County Clerk Kathleen Marchione said her office will not issue driver's licenses to illegal immigrants despite the new state policy.

"I have made a decision that I am not going to be issuing drivers licenses to illegal aliens," she said in a telephone

interview Friday.

Marchione said she made the decision after attending a press conference with Tedisco at the state Capitol on Friday morning, and used her license as identification to get into the parking garage.

"I came up to the trooper and he said, 'Driver's license, please.' It just hit me," Marchione said.

Other area county clerks contacted Friday said they are uncomfortable with the new policy, but will abide by it.

"We serve as agents of the state. That's our role," said Warren County Clerk Pam Vogel.

The change in policy will take effect for some illegal immigrants at the end of the year, and be fully implemented within the first six to eight months

of 2008, according to a press

release Spitzer issued last week.

Tedisco said the new state policy, which Spitzer announced last week, violates a section of state law that requires applicants for driver's licenses to provide a Social Security number or a letter from the Social Security Administration stating they are not eligible to participate in the system.

Christine Pritchard, a spokeswoman for Spitzer, said the state's highest-level appeals court has upheld the right of a state Department of Motor Vehicles commissioner to change policy.

"Those who are suggesting lawsuits fundamentally misunderstand the law in New York state," she said.

Pritchard said the policy change will ensure more illegal immigrants who drive will have proper training and insurance.

An American Automobile Association study found unlicensed and uninsured drivers are about five times more likely to be involved in accidents, she said.

If the strategy is successful at reducing accidents, she said, it could lead to lower car insurance premiums in New York.

The Social Security number requirement was added to DMV policy in 1995 as part of an effort to crack down on parents who do not pay child support, according to a document that state DMV Commissioner David Swarts recently distributed to county clerks.

In 2002, the state adopted a regulation allowing applicants ineligible for Social Security to receive driver's licenses, with certain documentation.

The controversial policy change expands how the state defines "ineligible."

Labor unions weighed in on the issue in support of the governor on Friday.

Allowing illegal immigrants to obtain driver's licenses will establish a system to track an estimated one million undocumented aliens in the state and make sure employers are not exploiting them, said Denis Hughes, state president of the AFL-CIO.

"We have to find out if these individuals are working, where they are working, and whether they're getting the same worker protection as everyone else," he said.

Local 1199 of SEIU United Healthcare Workers also issued a statement supporting the DMV policy change.

Area state legislators, however, said the policy change could compromise security because a driver's license is a primary identification used to board an airplane, gain admittance to a federal building or purchase a firearm.

"That gets you admission to so many places," said state Sen. Elizabeth Little, R-Queensbury.

Area legislators said they were disappointed Spitzer made the change by an executive order rather than through legislation.

"A democracy shouldn't be a one-man rule," said state Assemblyman Roy McDonald, R-Saratoga.

Tedisco said a reasonable compromise may be to issue illegal immigrants a color-coded driver's license that could not be used as identification for purposes such as boarding an

airplane, gaining access to a federal building or buying a gun.

Pritchard, the governor's spokeswoman, said a color-coded license would be counterproductive to the goal of encouraging illegal aliens to apply for driver's licenses.

"A different color license for a lawful immigrant versus an unlawful immigrant would be like a scarlet letter," she said.

Hughes, the AFL-CIO president, said he is not knowledgeable enough to comment on homeland security aspects, but he thinks some type of compromise is possible.

"I do recognize in this conversation that there's plenty of room to work out what to do," he said.

The New York State Association of County Clerks is scheduled to meet next week to discuss the issue.

"The issue is very confusing. We're looking for more clarification on this," said Vogel, of Warren County.

County clerks are concerned counties will not be compensated for extra time involved with the policy change, said Washington County Clerk Deborah Beahan.

Counties retain a percentage of revenues on transactions processed through their DMV offices.

There would be no payment, however, if illegal immigrants come to DMV offices for forms and information but decide not to apply for a license, Beahan said.

Essex County Clerk Joseph Provoncha said he will encourage the association to recommend the state limit processing of license applications for illegal immigrants to DMV district offices.

The closest district offices to Glens Falls are in Albany and Utica.

The controversy has spilled over into next year's local congressional race.

Three candidates seeking the Republican nomination to challenge incumbent U.S. Rep. Kirsten Gillibrand, D-Greenport, have issued statements opposing the policy change.

The three candidates who have issued statements are Michael Rocque of Saratoga County, Richard Wager of Dutchess County and John Wallace of Columbia County.

Wager issued a second statement saying the state should not punish county clerks who refuse to issue driver's licenses to illegal aliens.

Gillibrand issued a statement Friday reiterating a statement by her spokeswoman earlier in the week.

"I do not support giving driver's licenses to illegal immigrants," Gillibrand said in the statement.

Gillibrand said she supports federal legislation that will require applicants to show proof of citizenship in order to obtain a driver's license.

ALBANY - Republicans and county clerks around New York continued their assault yesterday on Gov. Eliot Spitzer's new policy to let illegal immigrants apply for driver's licenses.

The groundswell of criticism peaked yesterday as some county clerks vowed to disregard the new state policy and Republicans threatened to sue Spitzer if he doesn't change course.

The Democratic governor said last week that the state Department of Motor Vehicles soon would let New Yorkers apply for state driver's licenses without regard to immigration status.

That means illegal immigrants can show a foreign passport, for instance, and get a driver's license, a drastic shift from the policy established in 1995 that required proof of legal residency or a Social Security number when applying for a license.

Spitzer has defended the policy, even getting into a war of words this week with New York City Mayor Michael Bloomberg, who also has cast doubt on the plan.

Spitzer said the policy would improve security in New York by reducing the number of unlicensed drivers, bolster homeland security by better documenting illegal immigrants and reduce insurance premiums for New York drivers by an anticipated $120 million a year.

"We'd rather have them taking a driver's license exam if they are going to be on the road," Spitzer spokeswoman Christine Anderson said. "We'd rather that they have insurance, and we'd rather have them brought into the system rather than be just this sort of shadow population that nobody knows who they are."

Advocates for the plan suggested opponents are trying to play on people's fears of terrorism.

"As a progressive, enlightened society it is our responsibility to ensure a level playing field for all who want to work in this country," AFL-CIO President Dennis Hughes said. "This policy change is a step toward eliminating exploitation."

The state DMV is sending letters to 152,000 people in New York who have had a state license but are unable to renew it because of the old policy. Those people are being invited to reapply for licenses, likely starting in December.

In about six to eight months, the application process will be opened to all illegal immigrants who can show the necessary paperwork.

Republicans argued that if illegal immigrants have driver's licenses, the government would be unable to discern who is legal and who is not, potentially leading to safety breaches.

That also could lead to voter fraud, for example, because an illegal immigrant could flash a driver's license and register to vote, critics said.

Assembly Minority Leader James Tedisco, R-Schenectady, threatened to sue the state if the policy is not dropped and questioned whether Spitzer independently could adopt the policy without the Legislature's approval.

Tedisco went as far as to say that Osama bin Laden probably considers Spitzer's plan to be helpful.

He alleged Spitzer is trying to put "politics above public safety" by aiming to court immigrant voters.

Moreover, critics said the policy could clash with federal requirements that kick in next year to bolster ID standards nationwide.

Senate Republicans announced separately that they would submit legislation to prohibit the state from issuing driver's licenses to illegal immigrants.

"I am disturbed by the ramifications of this plan," said state Sen. Thomas Morahan, R-New City, the Senate majority liaison to the executive branch. "Relaxing the requirements endangers all New Yorkers and all Americans, making it easier for terrorists and illegal immigrants to obtain identification and access to services that, without a license, would be off limits."

Some county clerks, meanwhile, said they would not issue driver's licenses to illegal immigrants no matter what the state demands - likely setting up a court fight.

The state Association of County Clerks plans an emergency meeting Thursday to gauge how it may proceed.

"I'm not going to give a driver's license to someone who comes into my office and can't prove that they have legal status to be in New York," Rensselaer County Clerk Frank J. Merola said. "I refuse to do it."

In Monroe County, county Legislator David Malta has submitted legislation to bar County Clerk Cheryl Dinolfo from following the policy. Dinolfo said yesterday that the policy "should be rescinded. It encourages illegal activity in New York."

If county clerks disobey the law, they could face a lawsuit from the state, Spitzer's spokeswoman warned.

In most of the state's 62 counties, county clerks operate DMV offices on behalf of the state. In New York City, Long Island and Westchester, the state runs the DMV offices independently.

County clerks in most places "are legally required to perform DMV functions. It's a basic function of their public office," said Anderson, Spitzer's spokeswoman. "And turning away an otherwise eligible applicant raises serious equal protection and civil rights issues."

Open door policy allowed officials to walk in and arrest Ed and Elaine Brown

Tax protesters Ed and Elaine Brown were tricked by US Marshals who entered their home yesterday afternoon posing as supporters . The Marshals entered the house at a time when there were no other supporters present and catching the Browns off guard were able to arrest them and remove them from the property.

As we reported earlier this morning, the speculation was that the Browns were infiltrated and tricked before being violently subdued as authorities refuse to provide any details behind their arrest beside the fact that they did not peacefully surrender.

It is still unclear whether any violence was used to apprehend the Browns, all that is known is that they are now in federal custody and have begun serving their 63 month sentence.

Marshals spoke at a press conference at the federal courthouse in Concord NH today.

"Ultimately, this open-door policy that they seemed to have which allowed the Browns to have some supporters bring them supplies, welcome followers and even host a picnic --this proved to be their undoing. They invited us in. We escorted them out."

A small team of marshals pulled off the ruse, arresting the Browns without incident on the couple's front porch, Monier told local press .

Reports are suggesting that weapons have been seized at the property including "explosive devices", and "booby traps" which were placed in the woods. Monier added that the Browns may face further charges relating to the weapons.

Monier also added that officials have encountered no retaliatory action from supporters of the Browns as yet, but warned that any further supportive actions at this time could result in federal charges.

Just over two weeks ago Marshals handed out the following flyer to supporters who were attempting to attend one of the Browns' get togethers.

Note that the Browns were arrested by a MILITIA. No one else was
arrested, so the ENTIRE "militia" was federal police and

What's not discussed is the basic law on making citizens arrests, and
lawful use of justifiable homicide in self defense, as allowed in all
states in all state statutes, and used every day by private security
guards (who outnumber police), and anyone who defends their home from
burglers. Study the Battle of Athens Tennessee (1948) to see how 100
CITIZENS made SUCCESSFUL citizens arrests of an entire sheriff dept,
using military full-auto assault rifles and dynomite, in a 24-hour
gunfight, and they were NOT a "militia".

What's not discussed is how to win pro se, in city, state and fed
courts. The only way to win is to know Rules of Procedure, both Civil
and Criminal, and Rules of Evidence, in addition to Constitutional
Law, both state and federal, and Contract Law (UCC only applies when
it's codified into state statute for commercial law). What's not
discussed is how to win in traffic court, both state and federal,
which 100-million US citizens have to do every year in USA. If you
can't win in traffic court, which are by far the easiest of all
trials to win (especially parking tickets and robocop tickets which
can be thrown in the trash for lack of personal service of process),
there's no hope of winning in fed tax court. The US Constitution
guarantees a free right to travel without internal passport driver
license tax contract extorted at gunpoint by police state death squad.

Battles must be fought in courts of appeal, which REQUIRES LOSING in
the lower courts. That's the only way to set a legal precedent to
help everyone nationwide. Thus it is GOOD to lose in the trial court.
One purpose of "Peoples Court" TV shows is to brainwash the public to
waiver trial by jury, and to waiver all appeals, which they do when
they sign a contract to appear on "Peoples Court" TV shows. The REAL
Peoples Court is TRAFFIC COURT.

Getting back to the Brown debrief. They still have a NEW trial to
defend, with a jury, which will give them more free publicity to
expose the IRS tax scam. All court documents and evidence must be
posted online immediately. TV is not allowed inside fed courts,
because the fed courts are unconstitutional non-public star chambers.
BUT AUDIO/RADIO IS ALLOWED in fed courts, so do it every day. If Ed
can't win pro se in traffic court, if he lacks a proven success
record in traffic court, especially in fed traffic court, then he
requires a "licensed" lawyer who specializes in winning voluntary IRS
tax trials (Larry Beecraft). Ed and Dr Brown can still appeal their
conviction for income tax "evasion" -- THEY NEED TO DO THAT NOW.

Mistakes made by the Browns in hindsight:

BEFORE starting this battle, their real estate should have been
gifted to family or deeded into a trust, that they pay rent to
(prepaid for 10 years). That way the feds could never seize their
business or home, making it less profitable to attack the Browns, and
easier to just ignore them, like the IRS ignores 40-million other US
citizens who refuse to pay taxes every year.

BEFORE starting this battle, the Browns should have bought all the
defensive armaments, automated security systems, broadcasting systems
(the Ultimate Weapon of Mass Instruction and Deprogramming), and food
items they required for at least a 5-year seige. Only friends and
family should be trusted, not strangers in a "militia". That way no
fed militias would be able to infiltrate the Browns to purchase and
deliver these items, or to "provide security".

BEFORE starting this battle, the Browns should have already WON
dozens of traffic ticket trials pro se, in both civil and criminal
courts, including in fed court, including with juries, including in
courts of appeal, to learn the basics of presenting evidence and
court procedures. This knowledge could then be used in fed court on
this tax case, with or without a lawyer. There are many similarities
to traffic court and tax court, since both are Contract Law for
causes of action for alleged breach of civil contract. ALL contracts
are void for duress or fraud, or lack of "meeting of the minds"
because the contract is too complex. Getting certified by a paralegal
class and auditing law college classes, or gettign a law degree, is a
good idea.

BEFORE starting this battle, the Browns should have already started
their daily radio show. With their money they could have purchased a
licensed AM radio station in their town, with worldwide satallite
uplink and internet landlines. A shortwave Ham radio broadcast
station is also mandatory, for emergency use. A home TV studio can be
set up for less than $2,000 total, for live internet TV shows, and
for daily video uploads to the internet. The Browns should have been
running a cable access TV show, to win additional support in the
local community, just liek a politician. They could also have
campaigned for and been elected to public office. Too many "patriots"
sell the BS that the way to win against Gangsta Govt is to drop out
and quit fighting (this argument is perpetrated by govt mind
controllers).

When the Justice Department publicly declared torture ?abhorrent? in
a legal opinion in December 2004, the Bush administration appeared to
have abandoned its assertion of nearly unlimited presidential
authority to order brutal interrogations.

But soon after Alberto R. Gonzales's arrival as attorney general in
February 2005, the Justice Department issued another opinion, this
one in secret. It was a very different document, according to
officials briefed on it, an expansive endorsement of the harshest
interrogation techniques ever used by the Central Intelligence
Agency.

The new opinion, the officials said, for the first time provided
explicit authorization to barrage terror suspects with a combination
of painful physical and psychological tactics, including head-
slapping, simulated drowning and frigid temperatures.

Mr. Gonzales approved the legal memorandum on ?combined effects? over
the objections of James B. Comey, the deputy attorney general, who
was leaving his job after bruising clashes with the White House.
Disagreeing with what he viewed as the opinion's overreaching legal
reasoning, Mr. Comey told colleagues at the department that they
would all be ?ashamed? when the world eventually learned of it.

Later that year, as Congress moved toward outlawing ?cruel, inhuman
and degrading? treatment, the Justice Department issued another
secret opinion, one most lawmakers did not know existed, current and
former officials said. The Justice Department document declared that
none of the C.I.A. interrogation methods violated that standard.

The classified opinions, never previously disclosed, are a hidden
legacy of President Bush's second term and Mr. Gonzales's tenure at
the Justice Department, where he moved quickly to align it with the
White House after a 2004 rebellion by staff lawyers that had thrown
policies on surveillance and detention into turmoil.

Congress and the Supreme Court have intervened repeatedly in the last
two years to impose limits on interrogations, and the administration
has responded as a policy matter by dropping the most extreme
techniques. But the 2005 Justice Department opinions remain in
effect, and their legal conclusions have been confirmed by several
more recent memorandums, officials said. They show how the White
House has succeeded in preserving the broadest possible legal
latitude for harsh tactics.

A White House spokesman, Tony Fratto, said Wednesday that he would
not comment on any legal opinion related to interrogations. Mr.
Fratto added, ?We have gone to great lengths, including statutory
efforts and the recent executive order, to make it clear that the
intelligence community and our practices fall within U.S. law? and
international agreements.

More than two dozen current and former officials involved in
counterterrorism were interviewed over the past three months about
the opinions and the deliberations on interrogation policy. Most
officials would speak only on the condition of anonymity because of
the secrecy of the documents and the C.I.A. detention operations they
govern.

When he stepped down as attorney general in September after
widespread criticism of the firing of federal prosecutors and
withering attacks on his credibility, Mr. Gonzales talked proudly in
a farewell speech of how his department was ?a place of inspiration?
that had balanced the necessary flexibility to conduct the war on
terrorism with the need to uphold the law.

Associates at the Justice Department said Mr. Gonzales seldom
resisted pressure from Vice President Dick Cheney and David S.
Addington, Mr. Cheney's counsel, to endorse policies that they saw as
effective in safeguarding Americans, even though the practices
brought the condemnation of other governments, human rights groups
and Democrats in Congress. Critics say Mr. Gonzales turned his agency
into an arm of the Bush White House, undermining the department's
independence.

The interrogation opinions were signed by Steven G. Bradbury, who
since 2005 has headed the elite Office of Legal Counsel at the
Justice Department. He has become a frequent public defender of the
National Security Agency's domestic surveillance program and
detention policies at Congressional hearings and press briefings, a
role that some legal scholars say is at odds with the office's
tradition of avoiding political advocacy.

Mr. Bradbury defended the work of his office as the government's most
authoritative interpreter of the law. ?In my experience, the White
House has not told me how an opinion should come out,? he said in an
interview. ?The White House has accepted and respected our opinions,
even when they didn't like the advice being given.?

The debate over how terrorism suspects should be held and questioned
began shortly after the Sept. 11, 2001, attacks, when the Bush
administration adopted secret detention and coercive interrogation,
both practices the United States had previously denounced when used
by other countries. It adopted the new measures without public debate
or Congressional vote, choosing to rely instead on the confidential
legal advice of a handful of appointees.

The policies set off bruising internal battles, pitting
administration moderates against hard-liners, military lawyers
against Pentagon chiefs and, most surprising, a handful of
conservative lawyers at the Justice Department against the White
House in the stunning mutiny of 2004. But under Mr. Gonzales and Mr.
Bradbury, the Justice Department was wrenched back into line with the
White House.

After the Supreme Court ruled in 2006 that the Geneva Conventions
applied to prisoners who belonged to Al Qaeda, President Bush for the
first time acknowledged the C.I.A.'s secret jails and ordered their
inmates moved to Guantánamo Bay, Cuba. The C.I.A. halted its use of
waterboarding, or pouring water over a bound prisoner's cloth-covered
face to induce fear of suffocation.

But in July, after a monthlong debate inside the administration,
President Bush signed a new executive order authorizing the use of
what the administration calls ?enhanced? interrogation techniques ?
the details remain secret ? and officials say the C.I.A. again is
holding prisoners in ?black sites? overseas. The executive order was
reviewed and approved by Mr. Bradbury and the Office of Legal
Counsel.

Douglas W. Kmiec, who headed that office under President Ronald
Reagan and the first President George Bush and wrote a book about it,
said he believed the intense pressures of the campaign against
terrorism have warped the office's proper role.

?The office was designed to insulate against any need to be an
advocate,? said Mr. Kmiec, now a conservative scholar at Pepperdine
University law school. But at times in recent years, Mr. Kmiec said,
the office, headed by William H. Rehnquist and Antonin Scalia before
they served on the Supreme Court, ?lost its ability to say no.?

?The approach changed dramatically with opinions on the war on
terror,? Mr. Kmiec said. ?The office became an advocate for the
president's policies.?

From the secret sites in Afghanistan, Thailand and Eastern Europe
where C.I.A. teams held Qaeda terrorists, questions for the lawyers
at C.I.A. headquarters arrived daily. Nervous interrogators wanted to
know: Are we breaking the laws against torture?

The Bush administration had entered uncharted legal territory
beginning in 2002, holding prisoners outside the scrutiny of the
International Red Cross and subjecting them to harrowing pressure
tactics. They included slaps to the head; hours held naked in a
frigid cell; days and nights without sleep while battered by
thundering rock music; long periods manacled in stress positions; or
the ultimate, waterboarding.

Never in history had the United States authorized such tactics. While
President Bush and C.I.A. officials would later insist that the harsh
measures produced crucial intelligence, many veteran interrogators,
psychologists and other experts say that less coercive methods are
equally or more effective.

With virtually no experience in interrogations, the C.I.A. had
constructed its program in a few harried months by consulting
Egyptian and Saudi intelligence officials and copying Soviet
interrogation methods long used in training American servicemen to
withstand capture. The agency officers questioning prisoners
constantly sought advice from lawyers thousands of miles away.

?We were getting asked about combinations ? ?Can we do this and this
at the same time?'? recalled Paul C. Kelbaugh, a veteran intelligence
lawyer who was deputy legal counsel at the C.I.A.'s Counterterrorist
Center from 2001 to 2003.

Interrogators were worried that even approved techniques had such a
painful, multiplying effect when combined that they might cross the
legal line, Mr. Kelbaugh said. He recalled agency officers asking: ?
These approved techniques, say, withholding food, and 50-degree
temperature ? can they be combined?? Or ?Do I have to do the less
extreme before the more extreme??

The questions came more frequently, Mr. Kelbaugh said, as word spread
about a C.I.A. inspector general inquiry unrelated to the war on
terrorism. Some veteran C.I.A. officers came under scrutiny because
they were advisers to Peruvian officers who in early 2001 shot down a
missionary flight they had mistaken for a drug-running aircraft. The
Americans were not charged with crimes, but they endured three years
of investigation, saw their careers derailed and ran up big legal
bills.

That experience shook the Qaeda interrogation team, Mr. Kelbaugh
said. ?You think you're making a difference and maybe saving 3,000
American lives from the next attack. And someone tells you, ?Well,
that guidance was a little vague, and the inspector general wants to
talk to you,'? he recalled. ?We couldn't tell them, ?Do the best you
can,' because the people who did the best they could in Peru were
looking at a grand jury.?

Mr. Kelbaugh said the questions were sometimes close calls that
required consultation with the Justice Department. But in August
2002, the department provided a sweeping legal justification for even
the harshest tactics.

That opinion, which would become infamous as ?the torture memo? after
it was leaked, was written largely by John Yoo, a young Berkeley law
professor serving in the Office of Legal Counsel. His broad views of
presidential power were shared by Mr. Addington, the vice president's
adviser. Their close alliance provoked John Ashcroft, then the
attorney general, to refer privately to Mr. Yoo as Dr. Yes for his
seeming eagerness to give the White House whatever legal
justifications it desired, a Justice Department official recalled.

Mr. Yoo's memorandum said no interrogation practices were illegal
unless they produced pain equivalent to organ failure or ?even
death.? A second memo produced at the same time spelled out the
approved practices and how often or how long they could be used.

Despite that guidance, in March 2003, when the C.I.A. caught Khalid
Sheikh Mohammed, the chief planner of the Sept. 11 attacks,
interrogators were again haunted by uncertainty. Former intelligence
officials, for the first time, disclosed that a variety of tough
interrogation tactics were used about 100 times over two weeks on Mr.
Mohammed. Agency officials then ordered a halt, fearing the combined
assault might have amounted to illegal torture. A C.I.A. spokesman,
George Little, declined to discuss the handling of Mr. Mohammed. Mr.
Little said the program ?has been conducted lawfully, with great care
and close review? and ?has helped our country disrupt terrorist plots
and save innocent lives.?

?The agency has always sought a clear legal framework, conducting the
program in strict accord with U.S. law, and protecting the officers
who go face-to-face with ruthless terrorists,? Mr. Little added.

Some intelligence officers say that many of Mr. Mohammed's statements
proved exaggerated or false. One problem, a former senior agency
official said, was that the C.I.A.'s initial interrogators were not
experts on Mr. Mohammed's background or Al Qaeda, and it took about a
month to get such an expert to the secret prison. The former official
said many C.I.A. professionals now believe patient, repeated
questioning by well-informed experts is more effective than harsh
physical pressure.

Other intelligence officers, including Mr. Kelbaugh, insist that the
harsh treatment produced invaluable insights into Al Qaeda's
structure and plans.

?We leaned in pretty hard on K.S.M.,? Mr. Kelbaugh said, referring to
Mr. Mohammed. ?We were getting good information, and then they were
told: ?Slow it down. It may not be correct. Wait for some legal
clarification.'?

The doubts at the C.I.A. proved prophetic. In late 2003, after Mr.
Yoo left the Justice Department, the new head of the Office of Legal
Counsel, Jack Goldsmith, began reviewing his work, which he found
deeply flawed. Mr. Goldsmith infuriated White House officials, first
by rejecting part of the National Security Agency's surveillance
program, prompting the threat of mass resignations by top Justice
Department officials, including Mr. Ashcroft and Mr. Comey, and a
showdown at the attorney general's hospital bedside.

Then, in June 2004, Mr. Goldsmith formally withdrew the August 2002
Yoo memorandum on interrogation, which he found overreaching and
poorly reasoned. Mr. Goldsmith left the Justice Department soon
afterward. He first spoke at length about his dissenting views to The
New York Times last month, and testified before the Senate Judiciary
Committee on Tuesday.

Six months later, the Justice Department quietly posted on its Web
site a new legal opinion that appeared to end any flirtation with
torture, starting with its clarionlike opening: ?Torture is abhorrent
both to American law and values and to international norms.?

A single footnote ? added to reassure the C.I.A. ? suggested that the
Justice Department was not declaring the agency's previous actions
illegal. But the opinion was unmistakably a retreat. Some White House
officials had opposed publicizing the document, but acquiesced to
Justice Department officials who argued that doing so would help
clear the way for Mr. Gonzales's confirmation as attorney general.

If President Bush wanted to make sure the Justice Department did not
rebel again, Mr. Gonzales was the ideal choice. As White House
counsel, he had been a fierce protector of the president's
prerogatives. Deeply loyal to Mr. Bush for championing his career
from their days in Texas, Mr. Gonzales would sometimes tell
colleagues that he had just one regret about becoming attorney
general: He did not see nearly as much of the president as he had in
his previous post.

Among his first tasks at the Justice Department was to find a trusted
chief for the Office of Legal Counsel. First he informed Daniel
Levin, the acting head who had backed Mr. Goldsmith's dissents and
signed the new opinion renouncing torture, that he would not get the
job. He encouraged Mr. Levin to take a position at the National
Security Council, in effect sidelining him.

Mr. Bradbury soon emerged as the presumed favorite. But White House
officials, still smarting from Mr. Goldsmith's rebuffs, chose to
delay his nomination. Harriet E. Miers, the new White House counsel, ?
decided to watch Bradbury for a month or two. He was sort of on
trial,? one Justice Department official recalled.

Mr. Bradbury's biography had a Horatio Alger element that appealed to
a succession of bosses, including Justice Clarence Thomas of the
Supreme Court and Mr. Gonzales, the son of poor immigrants. Mr.
Bradbury's father had died when he was an infant, and his mother took
in laundry to support her children. The first in his family to go to
college, he attended Stanford and the University of Michigan Law
School. He joined the law firm of Kirkland & Ellis, where he came
under the tutelage of Kenneth W. Starr, the Whitewater independent
prosecutor.

Mr. Bradbury belonged to the same circle as his predecessors: young,
conservative lawyers with sterling credentials, often with clerkships
for prominent conservative judges and ties to the Federalist Society,
a powerhouse of the legal right. Mr. Yoo, in fact, had proposed his
old friend Mr. Goldsmith for the Office of Legal Counsel job; Mr.
Goldsmith had hired Mr. Bradbury as his top deputy.

?We all grew up together,? said Viet D. Dinh, an assistant attorney
general from 2001 to 2003 and very much a member of the club. ?You
start with a small universe of Supreme Court clerks, and you narrow
it down from there.?

But what might have been subtle differences in quieter times now
cleaved them into warring camps.

Justice Department colleagues say Mr. Gonzales was soon meeting
frequently with Mr. Bradbury on national security issues, a White
House priority. Admirers describe Mr. Bradbury as low-key but highly
skilled, a conciliator who brought from 10 years of corporate
practice a more pragmatic approach to the job than Mr. Yoo and Mr.
Goldsmith, both from the academic world.

?As a practicing lawyer, you know how to address real problems,? said
Noel J. Francisco, who worked at the Justice Department from 2003 to
2005. ?At O.L.C., you're not writing law review articles and you're
not theorizing. You're giving a client practical advice on a real
problem.?

As he had at the White House, Mr. Gonzales usually said little in
meetings with other officials, often deferring to the hard-driving
Mr. Addington. Mr. Bradbury also often appeared in accord with the
vice president's lawyer.

Mr. Bradbury appeared to be ?fundamentally sympathetic to what the
White House and the C.I.A. wanted to do,? recalled Philip Zelikow, a
former top State Department official. At interagency meetings on
detention and interrogation, Mr. Addington was at times ?
vituperative,? said Mr. Zelikow, but Mr. Bradbury, while taking
similar positions, was ?professional and collegial.?

While waiting to learn whether he would be nominated to head the
Office of Legal Counsel, Mr. Bradbury was in an awkward position,
knowing that a decision contrary to White House wishes could kill his
chances.

Charles J. Cooper, who headed the Office of Legal Counsel under
President Reagan, said he was ?very troubled? at the notion of a
probationary period.

?If the purpose of the delay was a tryout, I think they should have
avoided it,? Mr. Cooper said. ?You're implying that the acting
official is molding his or her legal analysis to win the job.?

Mr. Bradbury said he made no such concessions. ?No one ever suggested
to me that my nomination depended on how I ruled on any opinion,? he
said. ?Every opinion I've signed at the Office of Legal Counsel
represents my best judgment of what the law requires.?

Scott Horton, an attorney affiliated with Human Rights First who has
closely followed the interrogation debate, said any official offering
legal advice on the campaign against terror was on treacherous
ground.

?For government lawyers, the national security issues they were
deciding were like working with nuclear waste ? extremely hazardous
to their health,? Mr. Horton said.

?If you give the administration what it wants, you'll lose
credibility in the academic community,? he said. ?But if you hold
back, you'll be vilified by conservatives and the administration.?

In any case, the White House grew comfortable with Mr. Bradbury's
approach. He helped block the appointment of a liberal Ivy League law
professor to a career post in the Office of Legal Counsel. And he
signed the opinion approving combined interrogation techniques.

Mr. Comey strongly objected and told associates that he advised Mr.
Gonzales not to endorse the opinion. But the attorney general made
clear that the White House was adamant about it, and that he would do
nothing to resist.

Under Mr. Ashcroft, Mr. Comey's opposition might have killed the
opinion. An imposing former prosecutor and self-described
conservative who stands 6-foot-8, he was the rare administration
official who was willing to confront Mr. Addington. At one testy 2004
White House meeting, when Mr. Comey stated that ?no lawyer? would
endorse Mr. Yoo's justification for the N.S.A. program, Mr. Addington
demurred, saying he was a lawyer and found it convincing. Mr. Comey
shot back: ?No good lawyer,? according to someone present.

But under Mr. Gonzales, and after the departure of Mr. Goldsmith and
other allies, the deputy attorney general found himself isolated. His
troublemaking on N.S.A. and on interrogation, and in appointing his
friend Patrick J. Fitzgerald as special prosecutor in the C.I.A. leak
case, which would lead to the perjury conviction of I. Lewis Libby,
Mr. Cheney's chief of staff, had irreparably offended the White
House.

?On national security matters generally, there was a sense that Comey
was a wimp and that Comey was disloyal,? said one Justice Department
official who heard the White House talk, expressed with particular
force by Mr. Addington.

Mr. Comey provided some hints of his thinking about interrogation and
related issues in a speech that spring. Speaking at the N.S.A.'s Fort
Meade campus on Law Day ? a noteworthy setting for the man who had
helped lead the dissent a year earlier that forced some changes in
the N.S.A. program ? Mr. Comey spoke of the ?agonizing collisions? of
the law and the desire to protect Americans.

?We are likely to hear the words: ?If we don't do this, people will
die,'? Mr. Comey said. But he argued that government lawyers must
uphold the principles of their great institutions.

?It takes far more than a sharp legal mind to say ?no' when it
matters most,? he said. ?It takes moral character. It takes an
understanding that in the long run, intelligence under law is the
only sustainable intelligence in this country.?

Mr. Gonzales's aides were happy to see Mr. Comey depart in the summer
of 2005. That June, President Bush nominated Mr. Bradbury to head the
Office of Legal Counsel, which some colleagues viewed as a sign that
he had passed a loyalty test.

Soon Mr. Bradbury applied his practical approach to a new challenge
to the C.I.A.'s methods.

The administration had always asserted that the C.I.A.'s pressure
tactics did not amount to torture, which is banned by federal law and
international treaty. But officials had privately decided the agency
did not have to comply with another provision in the Convention
Against Torture ? the prohibition on ?cruel, inhuman, or degrading?
treatment.

Now that loophole was about to be closed. First Senator Richard J.
Durbin, Democrat of Illinois, and then Senator John McCain, the
Arizona Republican who had been tortured as a prisoner in North
Vietnam, proposed legislation to ban such treatment.

At the administration's request, Mr. Bradbury assessed whether the
proposed legislation would outlaw any C.I.A. methods, a legal
question that had never before been answered by the Justice
Department.

At least a few administration officials argued that no reasonable
interpretation of ?cruel, inhuman or degrading? would permit the most
extreme C.I.A. methods, like waterboarding. Mr. Bradbury was placed
in a tough spot, said Mr. Zelikow, the State Department counselor,
who was working at the time to rein in interrogation policy.

?If Justice says some practices are in violation of the C.I.D.
standard,? Mr. Zelikow said, referring to cruel, inhuman or
degrading, ?then they are now saying that officials broke current
law.?

In the end, Mr. Bradbury's opinion delivered what the White House
wanted: a statement that the standard imposed by Mr. McCain's
Detainee Treatment Act would not force any change in the C.I.A.'s
practices, according to officials familiar with the memo.

Relying on a Supreme Court finding that only conduct that ?shocks the
conscience? was unconstitutional, the opinion found that in some
circumstances not even waterboarding was necessarily cruel, inhuman
or degrading, if, for example, a suspect was believed to possess
crucial intelligence about a planned terrorist attack, the officials
familiar with the legal finding said.

In a frequent practice, Mr. Bush attached a statement to the new law
when he signed it, declaring his authority to set aside the
restrictions if they interfered with his constitutional powers. At
the same time, though, the administration responded to pressure from
Mr. McCain and other lawmakers by reviewing interrogation policy and
giving up several C.I.A. techniques.

Since late 2005, Mr. Bradbury has become a linchpin of the
administration's defense of counterterrorism programs, helping to
negotiate the Military Commissions Act last year and frequently
testifying about the N.S.A. surveillance program. Once he answered
questions about administration detention policies for an ?Ask the
White House? feature on a Web site.

Mr. Kmiec, the former Office of Legal Counsel head now at Pepperdine,
called Mr. Bradbury's public activities a departure for an office
that traditionally has shunned any advocacy role.

A senior administration official called Mr. Bradbury's active role in
shaping legislation and speaking to Congress and the press ?entirely
appropriate? and consistent with past practice. The official, who
spoke on the condition of anonymity, said Mr. Bradbury ?has played a
critical role in achieving greater transparency? on the legal basis
for detention and surveillance programs.

Though President Bush repeatedly nominated Mr. Bradbury as the Office
of Legal Counsel's assistant attorney general, Democratic senators
have blocked the nomination. Senator Durbin said the Justice
Department would not turn over copies of his opinions or other
evidence of Mr. Bradbury's role in interrogation policy.

?There are fundamental questions about whether Mr. Bradbury approved
interrogation methods that are clearly unacceptable,? Mr. Durbin
said.

John D. Hutson, who served as the Navy's top lawyer from 1997 to
2000, said he believed that the existence of legal opinions
justifying abusive treatment is pernicious, potentially blurring the
rules for Americans handling prisoners.

?I know from the military that if you tell someone they can do a
little of this for the country's good, some people will do a lot of
it for the country's better,? Mr. Hutson said. Like other military
lawyers, he also fears that official American acceptance of such
treatment could endanger Americans in the future.

?The problem is, once you've got a legal opinion that says such a
technique is O.K., what happens when one of our people is captured
and they do it to him? How do we protest then?? he asked.

Former president Jimmy Carter isn't just suspicious that the US is
using torture to extract intelligence from detainees -- he's
absolutely convinced.

Asked by CNN's Wolf Blitzer if, by Carter's definition of the word,
the United States had used torture during the Bush administration,
the Nobel Peace Prize winner was adamant:

"I don't think it, I know it," he said. "Certainly."

Pressed by Blitzer on whether that meant that President Bush was
lying, Carter was equally clear.

"The president is self-defning what we have done and authorized in
the torture of prisoners," said Carter."Yes."

Earlier in the interview, Carter said Bush's denial this week that
the US did not in fact torture detainees was "not an accurate
statement if you use the international norms of torture as has always
been honored in the last 60 years, since the Universal Declaration of
Human Rights was promulgated."

"But you can make your own definition of human rights and say we
don't violate them," he added, "and you can make your own defintion
of torture and say we don't violate them."

Carter was equally outspoken in a Wednesday interview with the BBC,
calling Vice President Dick Cheney a "disaster," according to
Reuters.

"He's a militant who avoided any service of his own in the military,"
he said of Cheney, adding that the vice president "has been most
forceful in the last 10 years or more in fulfilling some of his more
ancient commitments that the United States has a right to inject its
power through military means in other parts of the world."

"You know he's been a disaster for our country," Carter continued. "I
think he's been overly persuasive on President George Bush and quite
often he's prevailed."

Bono speaks out against torture - and gets censored

On September 27th, here in Philadelphia, the Liberty Medal for 2007
was awarded to Bono and his organization DATA (Debt AIDS Trade
Africa), for their work in fighting AIDS and poverty in Africa. Each
year, the National Constitution Center awards the Liberty Medal to a
person or persons for outstanding work in advancing the cause of
liberty around the world.

While Bono's entire acceptance speech was quite good, I was
particularly moved when he spoke out against the use of torture. He
said, "You do not have to become a monster to defeat a monster."

Indeed. Very well put.

And I wrote those words down right after I heard them, because I was
so impressed and wanted to share the wisdom.

However, two days after the event, I downloaded the official video of
Bono's speech at www.libertymedal.org. And I discovered that the
official video had been edited so that it no longer contains the
references to torture, or other portions of the speech that
apparently were not acceptable to The Powers That Be. Furthermore,
the edited version seems to over-emphasize the few gratuitous
positive comments that Bono made regarding the current Bush
administration. (By the way, George Bush Sr. presented the award.)

Not being a conspiracy theorist, I began to question whether I had
heard it all correctly the first time.

Fortunately, I discovered that Will Bunch of the Philadelphia Daily
News heard the same speech that I heard, and he wrote about it in his
blog at www.attytood.com. Bunch's blog entry about Bono's speech
fills in some of the gaps that are missing from the official video,
including the context surrounding Bono's "monster" comment.

So, thanks to Will Bunch, here is what Bono had to say about torture:

Today I read in the Economist an article reporting that over 38
percent of Americans support some type of torture in exceptional
circumstances. My country? No. Your country? Tell me no. Today, when
I receive this great honor, I ask you, I implore you as an Irishman
who has seen some of these things close up, I ask you to remember,
you do not have to become a monster to defeat a monster. Your
America's better than that.

Yes, that is exactly what I heard.

But, in the official video, all is missing except the last two
sentences.

Yes, this is America, land of the free. Or so it once appeared to be.

Let's face it: When you feel you must censor the acceptance speech of
a Liberty Medal recipient, something is seriously wrong.

Bush says that harsh interrogation techniques used to question
detainees are not torture. Fine, says an editor with the Washington
Post, let's use those same interrogation techniques on the president
and see if he still thinks they're not torture.

The Bush administration's authorisation of the use of torture has
returned to the headlines of the American mainstream media in the
past week after the New York Times uncovered secret Justice
Department documents that clearly, comprehensively gave authorisation
to "a combination of painful physical and psychological tactics,
including head-slapping, simulated drowning and frigid temperatures."

While Bush constantly claims "America does not torture people", the
president refuses to go into detail about exactly what methods of
interrogation are used in American, Afghanistan and Iraqi prisons and
detainee centres.

until George W. Bush and others in his administration endure
the "harsh" treatment to which terrorism suspects are subjected, then
Bush "will be remembered as the president who tried to justify

Leading members of the Congressional Steel Caucus have revealed that Chinese-made pipe and tube are being used to construct the congressionally mandated fence along the border with Mexico. They are demanding that something be done to ensure that American made products are used instead.

"It is outrageous, offensive, and unacceptable," says Rep. Jason Altmire (D-western PA). "If they are going to build this with steel it should be U.S. steel. No exceptions," said Rep. Phil English (R-western PA), who added that there are firms in his district that would love to supply materials for building the fence. English calls the barrier a "Great Wall of China."

The assembled members displayed a photograph of the fence -- only a small portion of which has been completed to date -- with piping that is clearly marked, "China." They say it was given to them by union activists, and that after seeing it, the members confirmed with the Department of Homeland Security that the government was indeed using Chinese-made pipe and tube. Not only that, DHS waived the "buy American" requirement written into the law that authorized construction.

It's not a matter of price, they say, but of national and economic security -- and also of quality. "They don't make safe toys," says Rep. Pete Visclosky (D-IN). "We ought to have a quality fence." Visclosky has asked DHS Secretary Chertoff to come to Congress and testify on the issue.

Presidential hopeful and critic of China Rep. Duncan Hunter was also on hand. He pointed out that of the 854 miles of barriers authorized by Congress a year ago, only five miles of double fencing and 70 miles of single fencing have so far been constructed.

Justice for Workers: 9th Circuit Says Workers Can Sue

It has been evident for quite some time that the political system
will not enforce immigration laws. In spite of overwhelming evidence
that rampant illegal immigration is an enormous financial burden to
taxpayers, a strain on public services and a threat to national
security, the pressure from ethnic blocs and cheap labor interests to
maintain a de facto open border continues to prevail.

But while the president and Congress are busy seeking ways to allow
millions of illegal aliens to gain amnesty, and while the governor of
California is weighing whether to grant driver's license privileges
to illegal aliens, and numerous city and county governments have
decided to accept Mexican-issued documents as a valid form of ID,
protection for those who have suffered as a result of unchecked
illegal immigration has come from the unlikeliest of places. The day
after Labor Day, a three-judge panel of the 9th Circuit Court of
Appeals - the same court that declared the Pledge of Allegiance
unconstitutional - ruled that workers, who lost jobs or wages because
employers knowingly hired illegal aliens, could sue those employers
under the RICO (Racketeering Influenced and Corrupt Organization)
statute.

As part of a 1996 immigration law, Congress added the repeated
practice of knowingly hiring or harboring illegal aliens as a
predicate act for prosecution under the RICO statute. In addition to
criminal prosecution by the government, the RICO laws attempt to
undermine criminal enterprises by allowing injured parties to collect
treble damages in civil suits.

Congress reasoned, in 1996, that if the clear motivation for
employers to knowingly hire illegal aliens is to save money on labor
costs, then exposing them to significant financial penalties if they
are caught would be a meaningful deterrent. Unlike the government,
which for political reasons might not have the incentive to go after
employer sanctions scofflaws, competitors and displaced workers
certainly would.

In March 2000 a group of legal immigrants and citizens did just that.
The workers alleged that two Washington State fruit packing companies
had conspired to hire illegal aliens to depress the wages of legally
authorized workers. In their Sept. 3 ruling, the 9th Circuit panel
agreed that the injuries suffered by the workers were "direct," which
is a crucial technical element proving causation under RICO. The
judges went on to note, "We are unable to discern a more direct
victim of illegal conduct."

The 9th Circuit ruling comes on the heels of a 2001 decision by the
2nd Circuit Court of Appeals. In that case the court ruled that under
RICO, a Connecticut cleaning company had standing to sue a competitor
that had gained an unfair advantage through the systematic practice
of hiring illegal aliens.

These two rulings, by two separate federal circuit courts, will
dramatically change the way immigration policy is enforced in
America. It is the profit motive, i.e., the desire of many employers
to hire workers who will work at lower wages that has stimulated
massive illegal immigration to the United States. As a result of
these legal decisions, competitors and displaced workers will have an
equally powerful financial incentive to seek redress for their losses
in civil court, and the monetary penalties under RICO are not just a
slap on the wrists.

While the two precedent setting cases involved small companies who
engaged in a pattern and practice of hiring illegal aliens, there is
big game to go after and big money to be collected, making this form
of litigation very attractive to the legal profession. Companies like
Tyson Foods - which faces criminal prosecution for not just employing
illegal aliens, but for smuggling them into the country - could
become inviting targets for suits by workers and competitors who have
been damaged by years of flagrant violation of immigration laws.

Nothing has been able to motivate the American government to enforce
its immigration laws - not overwhelming public support for tighter
controls, not even the reality and continued threat of international
terrorism. After decades of pleading for government action to curtail
massive illegal immigration, the public's recourse may come down to
the most American of all solutions: Sue the bastards!

Court rules: Illegal aliens not really 'illegal'

An appeals court has concluded that just being an illegal alien in
the United States doesn't necessarily violate the law, so a judge
cannot deny probation and require a jail sentence for a convicted
drug dealer who is an illegal alien.

The opinion from the Kansas Court of Appeals came in the Barton
County case involving convicted drug dealer Nicholas L. Martinez.

The ruling found that while the laws of the United States make it
illegal to enter the United States without authorization, being in
the United States after entering illegally is "not necessarily a
crime."

The trial court judge had ordered Martinez to jail on the grounds he
is an illegal alien, the report said.

But the appeals court overturned that decision.

"[Federal law] declares an alien's unsanctioned entry into the United
States to be a crime. While Congress has criminalized illegal entry
into this country, it has not made the continued presence of an
illegal alien in the United States a crime unless the illegal alien
has previously been deported and has again entered this country
illegally," the court opinion said. "[Federal law] makes it a felony
for an alien who has been deported to thereafter reenter the United
States or at anytime thereafter be found in the United States."

The court ruling explained that those entering the United States
illegally are subject to deportation, which can be based on "any
number of factors."


Judge Patrick McAnany, who wrote the opinion

"However, while an illegal alien is subject to deportation, that
person's ongoing presence in the United States is and of itself is
not a crime unless that person had been previously deported and
regained illegal entry into this country," the ruling, written by
Judge Patrick McAnany, said.

Barton County Attorney Douglas Matthews told the Wichita Eagle that
courts in at least two other states – Oregon and Minnesota – have
come to similar conclusions.

It was not immediately announced whether prosecutors would appeal the
conclusion to the state Supreme Court.

The defendant, court documents show, had pleaded guilty to possession
of cocaine, a felony, and endangering a child, because he had his
young son deliver drugs to a law enforcement officer working under
cover.

The facts of the case were not in dispute, the ruling said.

"Det. Terry L. Millard arranged for a controlled buy of illegal drugs
from Martinez. The first transaction was concluded with the transfer
of powered (sic) cocaine from Martinez' young son. The second
transaction was consummated by Martinez delivering the drugs," the
opinion noted.

Prosecutors had recommended probation, but Barton County District
Judge Hannelore Kitts ordered Martinez to jail for as long as year
because of his status as an illegal alien.

In court transcripts, Kitts said, "The problem that arises for me is
to follow the guidelines here, is because Mr. Martinez is illegally
in the country and is in violation of the probation rules right from
the start if I were to place him on probation."

Those probation rules forbid the defendant from violating any law
while on probation. The judge said the defendant would have to comply
with those conditions, but he couldn't do that because he violated
the law by being an illegal alien.

It was clear throughout the case that any legal status in the United
States for the defendant couldn't be substantiated.

His lawyer said, "I believe Mr. Martinez, because of his citizenship
and status, may or may not be eligible under Senate Bill 123 for the
mandatory treatment. He may or may not be here. I think – and I have
explained to Mr. Martinez that he risks the fate of his brother that
I represented on similar charges who was deported, and Mr. Martinez –
if the INS continues, both Mr. McPherson and I expect that that's
what's going to happen. We certainly have not guaranteed Mr. Martinez
that's not going to happen."

During sentencing, the trial court judge explained his process.

"The problem that arises for me is to follow the guidelines here is
because Mr. Martinez is illegally in the country and is in violation
of the probation rules right from the start if I were to place him on
probation. . . . [H]e . . . has to comply with all the conditions of
the probation and he can't do that because he's in violation of the
law not to violate any federal or state laws. And so for that reason,
I am going to have a big problem following these guidelines…," the
judge said.

The appellate ruling cited a 1958 conclusion from the U.S. Supreme
Court and another ruling, from 1979, in the 9th U.S. Circuit Court of
Appeals in California. Both cited the distinction between entering
the U.S. illegally and being in the U.S. illegally.

The Supreme Court has found "entry" is done only at "a particular
locality" and therefore "hardly suggests continuity."

Matthews said his staff is researching whether Martinez ever has been
deported.

The appellate ruling returned the case to district court for a
corrected sentencing.

Several folks who joined in a comment forum on the website for

The ruling came just days after WND reported the Census Bureau's
Deputy Director Preston Jay Waite told Associated Press in an
interview that immigration enforcement raids were suspended for
several months during the time the 2000 Census was assembled, and it
would help if that happens again in 2010

He said such enforcement, including raids to round up illegal aliens,
would just make a segment of the population that already distrusts
the government even less likely to cooperate with those who are
supposed to count those living in the United States that year.

Enforcement agents "have a job to do," Waite told the news
service. "They may not be able to give us as much of a break" in
2010.

The U.S. government's main disaster-response agency apologized on Friday for having its employees pose as reporters in a hastily called news conference on California's wildfires that no news organizations attended.

The agency had called the briefing with about 15 minutes notice as federal officials headed for southern California to oversee and assist in firefighting and rescue efforts. Reporters were also given a telephone number to listen in on but could not ask questions.

But with no reporters on hand and an agency video camera providing a feed carried live by some television networks, FEMA press employees posed the questions for Johnson that included: "Are you happy with FEMA's response so far?"

According to Friday's Post account, which Walker confirmed, Johnson replied that he was "very happy with FEMA's response so far."

He also said the agency had the benefit of "good leadership" and other factors, "none of which were present at Katrina." Chertoff was head of the Homeland Security Department during Katrina.

FEMA's administrator during Katrina, Michael Brown, resigned amid widespread criticism over his handling of the disaster, despite U.S. President George W. Bush's initial declaration that he was doing a "heck of a job."

E-mails between Brown and his colleagues over the course of the storm revealed a preoccupation with his media image, including his declaration, "I am a fashion god."

Mother Teresa, John Paul II, and the Fast-Track Saints,

During his 26-year papacy, John Paul II elevated 483 individuals to sainthood, more saints than all previous popes combined, it is reported. One personage he beatified but did not live long enough to canonize was Mother Teresa, the Roman Catholic nun of Albanian origin who had been wined and dined by the world's rich and famous while hailed as a champion of the poor. The darling of the corporate media and western officialdom, and an object of celebrity adoration, Teresa was for many years the most revered woman on earth, showered with kudos and awarded a Nobel Peace Prize in 1979 for her "humanitarian work" and "spiritual inspiration."

What usually went unreported were the vast sums she received from wealthy contributors, including a million dollars from convicted savings & loan swindler Charles Keating, on whose behalf she sent a personal plea for clemency to the presiding judge. She was asked by the prosecutor in that case to return Keating's gift because it was money he had stolen. She never did. She also accepted substantial sums given by the brutal Duvalier dictatorship that regularly stole from the Haitian public treasury.

Mother Teresa's "hospitals" for the indigent in India and elsewhere turned out to be hardly more than human warehouses in which seriously ill persons lay on mats, sometimes fifty to sixty in a room without benefit of adequate medical attention. Their ailments usually went undiagnosed. The food was nutritionally lacking and sanitary conditions were deplorable. There were few medical personnel on the premises, mostly untrained nuns and brothers.

When tending to her own ailments, however, Teresa checked into some of the costliest hospitals and recovery care units in the world for state-of-the-art treatment.

Teresa journeyed the globe to wage campaigns against divorce, abortion, and birth control. At her Nobel award ceremony, she announced that "the greatest destroyer of peace is abortion." And she once suggested that AIDS might be a just retribution for improper sexual conduct.

Teresa emitted a continual flow of promotional misinformation about herself. She claimed that her mission in Calcutta fed over a thousand people daily. On other occasions she jumped the number to 4000, 7000, and 9000. Actually her soup kitchens fed not more than 150 people (six days a week), and this included her retinue of nuns, novices, and brothers. She claimed that her school in the Calcutta slum contained five thousand children when it actually enrolled less than one hundred.

Teresa claimed to have 102 family assistance centers in Calcutta, but longtime Calcutta resident, Aroup Chatterjee, who did an extensive on-the-scene investigation of her mission, could not find a single such center.

As one of her devotees explained, "Mother Teresa is among those who least worry about statistics. She has repeatedly expressed that what matters is not how much work is accomplished but how much love is put into the work." Was Teresa really unconcerned about statistics? Quite the contrary, her numerical inaccuracies went consistently and self-servingly in only one direction, greatly exaggerating her accomplishments.

Over the many years that her mission was in Calcutta, there were about a dozen floods and numerous cholera epidemics in or near the city, with thousands perishing. Various relief agencies responded to each disaster, but Teresa and her crew were nowhere in sight, except briefly on one occasion.

When someone asked Teresa how people without money or power can make the world a better place, she replied, "They should smile more," a response that charmed some listeners. During a press conference in Washington DC, when asked "Do you teach the poor to endure their lot?" she said "I think it is very beautiful for the poor to accept their lot, to share it with the passion of Christ. I think the world is being much helped by the suffering of the poor people."

But she herself lived lavishly well, enjoying luxurious accommodations in her travels abroad. It seems to have gone unnoticed that as a world celebrity she spent most of her time away from Calcutta, with protracted stays at opulent residences in Europe and the United States, jetting from Rome to London to New York in private planes.

Mother Teresa is a paramount example of the kind of acceptably conservative icon propagated by an elite-dominated culture, a "saint" who uttered not a critical word against social injustice, and maintained cozy relations with the rich, corrupt, and powerful.

She claimed to be above politics when in fact she was pronouncedly hostile toward any kind of progressive reform. Teresa was a friend of Ronald Reagan, and a close friend of rightwing British media tycoon Malcolm Muggerridge. She was an admiring guest of the Haitian dictator "Baby Doc" Duvalier, and had the support and admiration of a number of Central and South American dictators.

Teresa was Pope John Paul II's kind of saint. After her death in 1997, he waved the five-year waiting period usually observed before beginning the beatification process that leads to sainthood. In 2003, in record time Mother Teresa was beatified, the final step before canonization.

But in 2007 her canonization confronted a bump in the road, it having been disclosed that along with her various other contradictions Teresa was not a citadel of spiritual joy and unswerving faith. Her diaries, investigated by Catholic authorities in Calcutta, revealed that she had been racked with doubts: "I feel that God does not want me, that God is not God and that he does not really exist." People think "my faith, my hope and my love are overflowing and that my intimacy with God and union with his will fill my heart. If only they knew," she wrote, "Heaven means nothing."

Through many tormented sleepless nights she shed thoughts like this: "I am told God loves me-and yet the reality of darkness and coldness and emptiness is so great that nothing touches my soul." Il Messeggero, Rome's popular daily newspaper, commented: "The real Mother Teresa was one who for one year had visions and who for the next 50 had doubts—up until her death."

Another example of fast-track sainthood, pushed by Pope John Paul II, occurred in 1992 when he swiftly beatified the reactionary Msgr. José María Escrivá de Balaguer, supporter of fascist regimes in Spain and elsewhere, and founder of Opus Dei, a powerful secretive ultra-conservative movement "feared by many as a sinister sect within the Catholic Church." Escrivá's beatification came only seventeen years after his death, a record run until Mother Teresa came along.

In accordance with his own political agenda, John Paul used a church institution, sainthood, to bestow special sanctity upon ultra-conservatives such as Escrivá and Teresa—and implicitly on all that they represented. Another of the ultra-conservatives whom John Paul made into a saint, bizarrely enough, was the last of the Hapsburg rulers of the Austro-Hungarian empire, Emperor Karl, who reigned during World War I.

John Paul also beatified Cardinal Aloysius Stepinac, the leading Croatian cleric who welcomed the Nazi and fascist Ustashi takeover of Croatia during World War II. Stepinac sat in the Ustashi parliament, appeared at numerous public events with top ranking Nazis and Ustashi, and openly supported the Croatian fascist regime.

In John Paul's celestial pantheon, reactionaries had a better chance at canonization than reformers. Consider his treatment of Archbishop Oscar Romero who spoke against the injustices and oppressions suffered by the impoverished populace of El Salvador and for this was assassinated by a right-wing death squad. John Paul never denounced the killing or its perpetrators, calling it only "tragic." In fact, just weeks before Romero was murdered, high-ranking officials of the Arena party, the legal arm of the death squads, sent a well-received delegation to the Vatican to complain of Romero's public statements on behalf of the poor.

Romero was thought by many poor Salvadorans to be something of a saint, but John Paul attempted to ban any discussion of his beatification for fifty years. Popular pressure from El Salvador caused the Vatican to cut the delay to twenty-five years. In either case, Romero was consigned to the slow track.

John Paul's successor, Benedict XVI, waved the five-year waiting period in order to put John Paul II himself instantly on a super-fast track to canonization, running neck and neck with Teresa. As of 2005 there already were reports of possible miracles attributed to the recently departed Polish pontiff.

One such account was offered by Cardinal Francesco Marchisano. When lunching with John Paul, the cardinal indicated that because of an ailment he could not use his voice. The pope "caressed my throat, like a brother, like the father that he was. After that I did seven months of therapy, and I was able to speak again." Marchisano thinks that the pontiff might have had a hand in his cure: "It could be," he said. Un miracolo! Viva il papa!

A Whistleblower's Tale

Former Alabama Governor Don Siegelman, one of the most popular progressive governors in Southern political history, is cleaning toilets in a Louisiana jail today, convicted on bribery charges in what may be one of the worst abuses of the federal courts by the executive branch during President Bush's tenure. Siegelman's case, among others, was taken up October 23 in a House Judiciary Committee hearing on selective prosecutions.

Siegelman was indicted by US Attorney Leura Canary, whose husband is a close friend of Karl Rove, and his seven-year sentence--the second-longest ever given to a politician convicted of bribery in this country--was doled out by Mark Fuller, a Republican judge who owes his lifetime appointment on the federal bench to the President. The bribery charges have nothing to do with personal enrichment but rather with donations Siegelman helped secure for a campaign to pass a lottery bill that would have increased funds for Alabama's ailing public schools.

Yet his case would probably never have been investigated by Congress if it weren't for the sworn statements of a lawyer and Republican Party operative from Alabama--statements, introduced into the public record at Tuesday morning's hearing, that have been the subject of much contentious debate among members of the committee.

The attorney, Dana Jill Simpson, was a longtime Republican player whose sworn affidavit alleges that Siegelman was tried and convicted as part of a conspiracy to keep him from running for political office in the future.

Simpson grew up in rural northern Alabama in a small town called Rainsville, in the foothills of the Appalachians, a place known mostly for its tasty tomatoes. In a state that once voted solidly with the Democrats, she comes from a long line of Republicans, at least on her mother's side.

Her father, an accountant and a Democrat, knew five-term Alabama Governor George Wallace well enough to get a letter from Wallace advocating her admittance to the University of Alabama law school in the early 1980s. Once admitted, however, she followed her mother's family tradition and got involved with the Moral Majority in antiabortion campaigns, supported Ronald Reagan's re-election bid in 1984 and went on to work as a volunteer for many Republicans over the years, including the Ten Commandments Judge, Roy Moore.

It was there at the university in Tuscaloosa that she came to know another ambitious Republican lawyer, Rob Riley, son of future Alabama Governor Bob Riley, who has been as loyal to Bush as any Republican governor in the nation. The two even share the habit of wearing cowboy boots with their dark suits.

Simpson ran against Rob Riley for president of the school's student government in 1987. Riley, as the fraternity machine candidate, won, but the two developed a friendship anyway and went on to try legal cases together for years.

Serving as president of the Alabama Student Government Association is a long tradition for those who want to be governor of the state, just as joining Yale's Skull and Bones has been for many Presidents, and Siegelman himself had served as its head in the late 1960s. Over the next three decades, Siegelman successfully ran for just about every public office in the state. He served as secretary of state and lieutenant governor, and after losing his first run for governor in 1990 he won in 1998 against a social conservative, Fob James--despite the fact that the state had long since turned red.

The people of Alabama split their tickets in the 1998 election, electing conservative Republican lawyer William Pryor as Attorney General. And almost from the day they each took office, Pryor began to plot a way to get rid of Siegelman--through the courts.

Siegelman, with his good looks, charm and willingness to compromise with the business crowd, was a popular governor at first, who fulfilled his campaign promise to rid the state's public schools of shoddy portable classrooms. But his biggest pledge, to pass a state lottery to fund public education, went down to defeat--largely due to the efforts of out-of-state gambling interests tied to convicted lobbyist Jack Abramoff, who used the Christian Coalition to turn out the religious vote against legalized gambling.

When Pryor's initial corruption investigation of Siegelman failed to uncover enough evidence to bring state charges--and after George W. Bush won the White House--he began to communicate with federal investigators. (In 2004 Bush granted Pryor an interim appointment to a federal judgeship on the US Court of Appeals for the Eleventh Circuit.)

During the early Bush years, Jill Simpson was still trying cases with Rob Riley. Together, the two hatched a plan to defeat Siegelman in 2002 by running Rob's dad for governor. Then a three-term Congressman, Bob Riley tossed his hat into the race and beat Siegelman by the slimmest of margins, 3,120 votes, in the closest election in Alabama political history. (The race, according to a study out of Auburn University, may have been marred by voting irregularities; an electronic recount moved thousands of votes from Siegelman's column to Riley's, though no vote counts for other candidates changed.)

The election was so close that a week and a half later, on November 16, Simpson took part in a political dirty trick to get Siegelman to concede the election rather than fight for a recount. Riley asked her to photograph a rally of the Ku Klux Klan in Scottsboro, Alabama, where she caught images of a lawyer aligned with the Democratic Party putting up "Riley for Governor" signs. It turned out later that the lawyer was likely set up by the Riley campaign.

Last spring, as she watched the legal case against Siegelman proceed, Simpson was asked by the Rileys to conduct further "research" she considered to be unethical and illegal about a powerful member of the state legislature. For this longtime Republican ballplayer, it was the last straw. In May Simpson signed a sworn affidavit in which she asserted that she was in on a telephone conversation in which she overheard members of the Riley campaign plot to get Siegelman to concede the election.

Simpson's affidavit tells of a conference call she was on just two days after that Klan rally, whose topic was the 2002 recount battle. She has phone records that prove the phone call took place. Also on the call were Bill Canary, a senior GOP political operative and adviser to Governor-elect Riley; the governor's son, Rob Riley; and Terry Butts, a former member of the Alabama Supreme Court who worked for Riley's election in 2002 (he later ended up representing Siegelman's co-defendant.)

According to Simpson's affidavit, Canary said "not to worry about Don Siegelman" because "his girls" would "take care of him." Canary made it clear "his girls" was a reference to his wife, Leura Canary, the US Attorney who first brought the case against Siegelman in the Middle District of Alabama, and Alice Martin, the US Attorney for the Northern District of the state, whose own case against Siegelman was later thrown out by a federal judge. Both "girls" were recent Bush appointees and past members of the Federalist Society, a conservative legal fraternity.

During the conference call, Rob Riley asked if he was sure "these girls" could "take care of" Siegelman and get him out of the way of any future political race. Canary told him "not to worry" and that he had already worked it out with Karl Rove, who had spoken to the Justice Department, which, he said, was already "pursuing" an investigation of Siegelman.

Simpson testified that Butts said he could get Siegelman to concede and that "it would all be over," including future prosecutions, if Siegelman would just step aside. That same day, Siegelman withdrew his recount request.

Four months after testifying in that affidavit, Simpson went to Washington and gave a sworn deposition to the House Judiciary Committee in which she shared further details about the call, including discussion of a plan to keep Siegelman out of future elections for governor--by threatening him with legal action if he ever ran again.

At Tuesday's House Judiciary Committee hearing on three cases of selective prosecution involving the Bush Justice Department, Siegelman's conviction and Simpson's evidence were center stage.

Former US Attorney Doug Jones, now in private practice in Birmingham, testified about what he called "a disturbing trend" of selective prosecutions on the part of the Bush Justice Department. "There is no question in my mind that the Department of Justice in Washington was behind the investigation," Jones told the committee. And he said there is no question in his mind that it was "driven by politics." That trend was documented by University of Missouri communications professor Donald Shields, who spoke Tuesday about his findings, in a peer-reviewed study, that the Bush Justice Department has investigated and tried far more Democrats than Republicans. "There is no question" that politics has been involved, Shields testified Tuesday. "The numbers don't lie."

Artur Davis, a Democratic Representative from Birmingham, echoed the view of Jones and Shields. "At every turn we see partisan politics, Washington politics, Karl Rove politics," Davis said.

Siegelman, whose case is now under review by a federal appeals court in Atlanta, has charged that the federal prosecution of him was "political" since he was first indicted in Birmingham by US Attorney Alice Martin, a Bush appointee, on corruption charges. He continued to say it after that case was thrown out of court in 2004, and when he was indicted again in 2005 by Leura Canary. Her husband, Bill, a key player in that fateful 2002 conference call, is president of the Conservative Business Council of Alabama and previously worked in Washington as a special assistant for intergovernmental affairs for George H.W. Bush. It was Canary who invited Rove down to Alabama back in 1994 to help orchestrate a Republican takeover of the Alabama Supreme Court.

The next political prosecution worked. A federal grand jury indicted Siegelman and ex-HealthSouth chief Richard Scrushy in October 2005 on what prosecutors called a "widespread racketeering conspiracy" including bribery, conspiracy, obstruction of justice and mail fraud. The case centered on two $250,000 checks Scrushy wrote to a political group to pay off the debt it had incurred supporting Siegelman's campaign for a state education lottery. Prosecutors alleged that Scrushy wrote those checks in exchange for reappointment to a state hospital regulatory board on which he had served under previous governors.

After a long deliberation and indications that the jury was hopelessly hung, and after the judge issued a charge telling the jurors he had "a lifetime appointment" and could wait as long as it took for them to reach a unanimous verdict, some jurors started reading online news coverage and communicating by e-mail, pressuring others to come to a guilty verdict so they could all go home. On June 29, 2006, they found Siegelman not guilty of all twenty-five racketeering charges but found him guilty on one count of bribery and five instances of mail fraud. They found both Siegelman and Scrushy guilty of conspiracy and obstruction of justice.

But no one listened to Siegelman's claims of a political prosecution until May, when Simpson came forward.

CBS's 60 Minutes has interviewed Simpson for a show to air in the next few weeks. In that interview, she tells much of her story and documents her own close connections to the Bush White House and Karl Rove. But I was the first reporter to do an in-person, on-the-record interview with her, back in June.

"The reason I did what I did is because I believe everybody has a Sixth Amendment right to a fair trial," she said then. "I did not believe Mr. Siegelman or Mr. Scrushy got a fair trial."

Since Simpson came forward in May, she has not exactly been embraced as a truth-teller by the local press in Alabama--and she has been isolated and assaulted by the very Republicans she once helped. In September she told House Judiciary Committee staff that her law practice and her family members have suffered a backlash. "It has been very stressful," she testified, "and it's been difficult for my family." She says business at her law firm has dried up since she went public about political collusion in the prosecution of Siegelman.

Several Alabama newspapers have quoted Rob Riley disputing Simpson's version of events and attempting to discredit her. Not long after the story broke on June 1, Riley told a Birmingham News reporter that he had not seen her in years and never tried cases with her. But she has boxes of records proving they tried many cases together over the years, some of which she provided to the House Judiciary Committee. It became evident at Tuesday's hearing that Riley filed an affidavit with the House Judiciary Committee denying that the 2002 conference call ever took place, but Representative Davis said it should be discounted by the committee, since Simpson's phone records clearly corroborate the call.

Terry Butts, the State Supreme Court justice who claimed on the call that he could get Siegelman to concede, hurled insults at Simpson, saying her affidavit was written "by a drunken fiction writer." In a story October 23 on National Public Radio, Rob Riley called her charges "crazy."

Did the attacks go beyond mere words? On February 21, just after Simpson began to leak what she knew about the phone conversation with the Alabama Bar Association, one of Siegelman's lawyers and lawyers for Richard Scrushy, Simpson's family home in Rainsville burned down. A cursory investigation of the house fire by the Rainsville Fire Department and Simpson's insurance company turned up no evidence of arson.

Then on March 1, as Simpson was returning from Birmingham after a meeting with Scrushy and his legal team, a car followed her "for a long way" on state Highway 431 before swerving into her lane, twice and running her off the road. The driver turned out to be a former police officer working as a private investigator. The state trooper who investigated the accident said he saw no evidence of foul play. Police officers in Attalla and Gadsden who know the investigator say they doubted foul play in the wreck.

But the coincidental timing of the incidents scared her, nevertheless. "I made the decision in May to speak truth to power," Simpson said in an interview. "Anytime you speak truth to power, there are great risks. I've been attacked," she says, but she felt a "moral obligation" to speak up.

Meanwhile, the Canarys continue to deny any political plot, as has US Attorney Louis Franklin, who claims he was the sole person behind Siegelman's prosecution.

Yet there is ample evidence that Siegelman's case was reviewed by the Public Integrity Division of the Justice Department in Washington, which issued an order to bring the case to court no matter what the evidence showed. Former US Attorney Doug Jones, who as a lawyer in private practice represented Siegelman briefly in 2004, has said the case against Siegelman appeared weak and indications were it would not be pursued back in 2004--until a "top-down" review was ordered in Washington. He testified before the House Judiciary Committee October 23 and said that the Siegelman prosecution was "driven by politics."

"There is no question in my mind that the Department of Justice in Washington was behind the investigation," he said, adding, in response to questions from committee members, "there is no question" there were people in the Justice Department who were "out to get Siegelman."

"I'm no fan of Rove. I think he is a disgusting political animal," Jones said in an earlier interview. "I don't like the way he has interfered, and I do think his fingerprints are on a lot of the prosecutions that have gone on around the country. No question about that. Congress ought to investigate that, because it's wrong.

"Once you become Attorney General you are supposed to leave the partisan politics at the door," he continued. "It does not appear that this Justice Department has done that, whether it's with Siegelman or some of the other cases around the country."

It is unclear yet whether Simpson will be called to testify in future hearings before Congress. And House Judiciary Committee chairman John Conyers, the Michigan Democrat, has not yet indicated whether he will continue to pursue charges against Karl Rove, who resigned in August while defying Congressional subpoenas in a broad claim of White House executive privilege. But Simpson's affidavit got a bit of sunshine this week.

Simpson said she hopes people understand how hard it is to speak out against the Bush/Rove political machine and to abandon party loyalty to serve the law.

"But I've done it, now," she says. "And I will take whatever consequences that may come from it, because it was the right thing to do. I just couldn't walk away from the fact--and there's no doubt about it--it was a political persecution."
